Il consumatore ha il diritto di recedere dal contratto di acquisto concluso sul sito L'Impastautore, senza dover fornire alcuna motivazione e senza dover sostenere costi diversi da quelli espressamente indicati nella presente policy, entro quattordici (14) giorni di calendario dalla data in cui il consumatore stesso, o un terzo da lui designato (diverso dal vettore), acquisisce il possesso fisico dei beni acquistati. Nel caso in cui il consumatore abbia acquistato più beni con un unico ordine e questi vengano consegnati separatamente, il termine di quattordici giorni decorre dal giorno in cui il consumatore acquisisce il possesso fisico dell'ultimo bene. Il diritto di recesso è disciplinato dall'art. 52 del D.lgs. 206/2005 (Codice del Consumo) e si applica a tutti gli acquisti di prodotti fisici effettuati sul sito, salvo le eccezioni indicate al successivo punto 3.

Per esercitare il diritto di recesso, il consumatore deve comunicare la propria decisione di recedere dal contratto prima della scadenza del termine di quattordici giorni mediante una dichiarazione esplicita e inequivocabile. La comunicazione può essere inviata tramite uno dei seguenti canali: - Email: xschieri41@gmail.com - PEC: alessandroschieri@pec.it - Posta ordinaria o raccomandata: Alessandro Schieri – L'Impastautore, Via Chiesa di Redù 34, 41015 Nonantola (MO), Italia La comunicazione deve contenere: - il nome e cognome del consumatore; - il numero d'ordine o altro elemento idoneo a identificare l'acquisto; - i prodotti per i quali si intende esercitare il recesso; - la data di ricezione dei beni; - l'indirizzo di spedizione per il ritiro o la restituzione. A tal fine il consumatore può utilizzare il modulo tipo di recesso previsto dall'Allegato I, Parte B, del D.lgs. 206/2005, il cui testo è riportato di seguito a titolo esemplificativo: «Destinatario: Alessandro Schieri – L'Impastautore, Via Chiesa di Redù 34, 41015 Nonantola (MO) – Email: xschieri41@gmail.com – PEC: alessandroschieri@pec.it Con la presente notifica il/la sottoscritto/a [nome e cognome] il recesso dal contratto di vendita dei seguenti beni [descrizione beni], ordinati il [data ordine] e ricevuti il [data ricezione]. Data: [data] Firma (solo se il modulo è inviato in formato cartaceo): ___________» L'uso del modulo tipo non è obbligatorio: è sufficiente qualsiasi dichiarazione scritta che manifesti in modo chiaro la volontà di recedere. Il recesso si considera tempestivamente esercitato se la comunicazione è inviata prima della scadenza del termine di quattordici giorni, indipendentemente dalla data di ricezione da parte del Titolare. Il Titolare invierà senza indugio una conferma di ricevimento della comunicazione di recesso su supporto durevole.

Ai sensi dell'art. 59 del D.lgs. 206/2005, il diritto di recesso è escluso o non può essere esercitato nei seguenti casi, applicabili all'attività di L'Impastautore: - Beni confezionati su misura o chiaramente personalizzati, realizzati in base alle specifiche del consumatore (ad esempio impasti, preparazioni o confezioni realizzate su richiesta specifica del cliente). - Beni che rischiano di deteriorarsi o scadere rapidamente (ad esempio prodotti alimentari freschi, impasti, lievitati o altri prodotti con breve shelf life). - Beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute e che siano stati aperti dopo la consegna. Si invita il consumatore a verificare attentamente la natura del prodotto acquistato prima di procedere all'ordine. In caso di dubbi sull'applicabilità del diritto di recesso a uno specifico prodotto, è possibile contattare il Titolare ai recapiti indicati al punto 6 prima di effettuare l'acquisto.

A seguito dell'esercizio del diritto di recesso, il consumatore è tenuto a restituire i beni al Titolare senza indebito ritardo e, in ogni caso, entro quattordici (14) giorni di calendario dalla data in cui ha comunicato la propria decisione di recedere dal contratto. Il termine si considera rispettato se il consumatore rispedisce i beni prima della scadenza del periodo di quattordici giorni. Condizioni dei beni resi: - I beni devono essere restituiti integri, nella loro confezione originale (ove possibile), completi di tutti gli accessori, etichette e documentazione eventualmente allegata. - Il consumatore è responsabile della diminuzione di valore dei beni risultante da una manipolazione degli stessi diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni stessi, ai sensi dell'art. 57, comma 2, del D.lgs. 206/2005. - Il Titolare si riserva il diritto di trattenere il rimborso fino al ricevimento dei beni o fino a quando il consumatore non abbia dimostrato di aver rispedito i beni, a seconda di quale situazione si verifichi per prima. Si raccomanda di utilizzare un servizio di spedizione tracciabile e di conservare la ricevuta di spedizione, poiché il Titolare non risponde di eventuali smarrimenti o danni durante il trasporto di ritorno.

Il Titolare rimborserà tutti i pagamenti ricevuti dal consumatore, incluse le spese di consegna standard (ad eccezione dei costi supplementari derivanti dall'eventuale scelta del consumatore di un tipo di consegna diverso da quello standard meno costoso offerto), senza indebito ritardo e, in ogni caso, entro quattordici (14) giorni di calendario dalla data in cui il Titolare è informato della decisione del consumatore di recedere dal contratto, subordinatamente al ricevimento dei beni restituiti o alla prova dell'avvenuta spedizione da parte del consumatore. Il rimborso viene effettuato utilizzando lo stesso mezzo di pagamento usato dal consumatore per la transazione iniziale. Poiché i pagamenti sul sito L'Impastautore sono gestiti tramite Stripe (Stripe Payments Europe, Ltd.), il rimborso sarà accreditato sul metodo di pagamento originariamente utilizzato (carta di credito/debito o altro strumento supportato da Stripe) tramite la medesima piattaforma. I tempi tecnici di accredito dipendono dall'istituto bancario o dall'emittente della carta del consumatore e possono variare, ma in ogni caso l'operazione di rimborso sarà avviata dal Titolare entro il termine sopra indicato. Il rimborso non comporta alcun costo aggiuntivo per il consumatore.

Si ricorda che, in caso di controversia, il consumatore residente nell'Unione Europea può avvalersi della piattaforma di risoluzione delle controversie online (ODR) messa a disposizione dalla Commissione europea all'indirizzo: https://ec.europa.eu/consumers/odr. Il consumatore ha inoltre il diritto di adire il giudice del luogo in cui ha la propria residenza o domicilio, ai sensi dell'art. 33, comma 2, lett. u), del D.lgs. 206/2005.

The consumer has the right to withdraw from any purchase contract concluded on the L'Impastautore website, without giving any reason and without incurring any costs other than those expressly set out in this policy, within fourteen (14) calendar days from the date on which the consumer, or a third party designated by the consumer (other than the carrier), takes physical possession of the purchased goods. If the consumer has purchased multiple goods in a single order and these are delivered separately, the fourteen-day period begins on the day the consumer takes physical possession of the last item. The right of withdrawal is governed by Article 52 of Italian Legislative Decree 206/2005 (Consumer Code) and applies to all purchases of physical products made on the website, subject to the exceptions set out in Section 3 below.

To exercise the right of withdrawal, the consumer must communicate the decision to withdraw from the contract before the expiry of the fourteen-day period by means of an explicit and unequivocal statement. The withdrawal is considered to have been exercised in time if the communication is sent before the expiry of the fourteen-day period, regardless of when it is received by the Data Controller. The Data Controller will send, without undue delay, an acknowledgement of receipt of the withdrawal communication on a durable medium.

Pursuant to Article 59 of Italian Legislative Decree 206/2005, the right of withdrawal is excluded or cannot be exercised in the following cases, which are relevant to the activities of L'Impastautore: - Goods made to the consumer's specifications or clearly personalised (for example, doughs, preparations or packages produced according to the customer's specific instructions). - Goods that are liable to deteriorate or expire rapidly (for example, fresh food products, doughs, leavened products or other goods with a short shelf life). - Sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery. Consumers are strongly advised to carefully check the nature of the product before placing an order. If there is any doubt as to whether the right of withdrawal applies to a specific product, please contact the Data Controller at the details provided in Section 6 before completing the purchase.

Following the exercise of the right of withdrawal, the consumer must return the goods to the Data Controller without undue delay and, in any event, within fourteen (14) calendar days from the date on which the consumer communicated the decision to withdraw. The deadline is met if the consumer sends back the goods before the fourteen-day period has expired. Conditions of returned goods: - Goods must be returned intact, in their original packaging (where possible), complete with all accessories, labels and any documentation originally included. - The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods, pursuant to Article 57(2) of Italian Legislative Decree 206/2005. - The Data Controller reserves the right to withhold the refund until the goods have been received or until the consumer has supplied evidence of having sent back the goods, whichever is the earliest. Consumers are advised to use a trackable shipping service and to retain proof of postage, as the Data Controller accepts no liability for loss or damage during the return shipment.

The Data Controller will reimburse all payments received from the consumer, including standard delivery costs (with the exception of any supplementary costs arising from the consumer's choice of a type of delivery other than the least expensive standard delivery option offered), without undue delay and, in any event, within fourteen (14) calendar days from the date on which the Data Controller is informed of the consumer's decision to withdraw, subject to receipt of the returned goods or evidence of their dispatch by the consumer. The refund will be made using the same means of payment used by the consumer for the original transaction. Since payments on the L'Impastautore website are processed through Stripe (Stripe Payments Europe, Ltd.), the refund will be credited to the original payment method used (credit/debit card or other Stripe-supported instrument) via the same platform. The technical processing time for the credit to appear depends on the consumer's bank or card issuer and may vary; however, the Data Controller will initiate the refund operation within the deadline stated above. The refund will not incur any additional charges for the consumer.
