Il consumatore ha il diritto di recedere dal contratto di acquisto concluso sul sito L'Impastautore, senza dover fornire alcuna motivazione e senza dover sostenere costi diversi da quelli espressamente previsti dalla presente politica, entro quattordici (14) giorni di calendario dalla data in cui il consumatore stesso, o un terzo da lui designato (diverso dal vettore), acquisisce il possesso fisico dei beni acquistati. Nel caso in cui il consumatore abbia acquistato più beni con un unico ordine e questi vengano consegnati separatamente, il termine di quattordici giorni decorre dalla data in cui il consumatore acquisisce il possesso fisico dell'ultimo bene. Il diritto di recesso è disciplinato dagli articoli 52 e seguenti del D.lgs. 206/2005 (Codice del Consumo).

Per esercitare il diritto di recesso, il consumatore deve comunicare la propria decisione di recedere dal contratto prima della scadenza del termine di quattordici giorni mediante una dichiarazione esplicita e inequivocabile. L'onere della prova relativo all'esercizio del diritto di recesso entro il termine di legge grava sul consumatore. A tal fine, si raccomanda di conservare la ricevuta di invio della comunicazione (es. ricevuta di consegna dell'email o della PEC, ricevuta postale). Il recesso si considera tempestivo se la comunicazione è inviata prima della scadenza del termine di quattordici giorni.

Ai sensi dell'articolo 59 del D.lgs. 206/2005, il diritto di recesso è escluso o non può essere esercitato nei seguenti casi, applicabili ai prodotti venduti su L'Impastautore: - Beni confezionati su misura o chiaramente personalizzati, realizzati in base alle specifiche indicazioni del consumatore. - Beni che rischiano di deteriorarsi o scadere rapidamente (ad esempio prodotti alimentari freschi, deperibili o con data di scadenza ravvicinata). - Beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute e che siano stati aperti dopo la consegna. Si invita il consumatore a verificare attentamente le caratteristiche del prodotto acquistato prima di procedere all'ordine. In caso di dubbi sull'applicabilità delle eccezioni al proprio acquisto, è possibile contattare il Titolare ai recapiti indicati nella sezione 6.

A seguito dell'esercizio del diritto di recesso, il consumatore è tenuto a restituire i beni acquistati senza indebito ritardo e, in ogni caso, entro quattordici (14) giorni di calendario dalla data in cui ha comunicato la propria decisione di recedere dal contratto. Il termine si considera rispettato se il consumatore rispedisce i beni prima della scadenza del periodo di quattordici giorni. Le spese dirette di restituzione dei beni sono a carico del consumatore, salvo diverso accordo scritto con il Titolare. I beni devono essere restituiti al seguente indirizzo: Alessandro Schieri — Via chiesa di Redù 34, 41015 Nonantola (MO), Italia Condizioni dei beni resi: Il consumatore è responsabile della diminuzione di valore dei beni risultante da una manipolazione dei beni diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni stessi. I prodotti devono essere restituiti integri, nella loro confezione originale (ove possibile), completi di tutti gli accessori, istruzioni e documentazione eventualmente inclusi, e privi di segni di utilizzo che vadano oltre la normale verifica del bene. Il Titolare si riserva il diritto di detrarre dal rimborso un importo corrispondente alla diminuzione di valore del bene, qualora questa sia imputabile a una manipolazione non consentita da parte del consumatore.

Il Titolare provvederà a rimborsare tutti i pagamenti ricevuti dal consumatore, incluse le spese di consegna standard (ad eccezione dei costi supplementari derivanti dall'eventuale scelta di un tipo di consegna diverso da quello standard e meno costoso offerto), senza indebito ritardo e, in ogni caso, entro quattordici (14) giorni di calendario dalla data in cui il Titolare è informato della decisione del consumatore di recedere dal contratto. Il Titolare può trattenere il rimborso finché non abbia ricevuto i beni oppure finché il consumatore non abbia dimostrato di aver rispedito i beni, a seconda di quale situazione si verifichi per prima. Il rimborso sarà effettuato utilizzando lo stesso mezzo di pagamento usato dal consumatore per la transazione iniziale. Poiché i pagamenti sul sito L'Impastautore sono gestiti tramite Stripe (Stripe Payments Europe, Ltd.), il rimborso sarà accreditato sul metodo di pagamento originariamente utilizzato (carta di credito/debito o altro strumento supportato da Stripe) senza che al consumatore siano addebitati costi aggiuntivi in conseguenza del rimborso. I tempi tecnici di accredito sul conto del consumatore dipendono dall'istituto bancario o dall'emittente della carta e possono variare; il Titolare non è responsabile di eventuali ritardi imputabili a tali soggetti.

The consumer has the right to withdraw from the purchase contract concluded on the L'Impastautore website, without giving any reason and without incurring any costs other than those expressly provided for in this policy, within fourteen (14) calendar days from the date on which the consumer, or a third party designated by the consumer (other than the carrier), takes physical possession of the purchased goods. If the consumer has purchased multiple goods in a single order and these are delivered separately, the fourteen-day period runs from the date on which the consumer takes physical possession of the last item. The right of withdrawal is governed by Articles 52 et seq. of Legislative Decree No. 206/2005 (Consumer Code).

To exercise the right of withdrawal, the consumer must communicate the decision to withdraw from the contract before the expiry of the fourteen-day period by means of an explicit and unambiguous statement. The burden of proof regarding the timely exercise of the right of withdrawal lies with the consumer. It is therefore recommended to retain proof of dispatch of the communication (e.g. email delivery receipt, certified email receipt, postal receipt). Withdrawal is considered timely if the communication is sent before the expiry of the fourteen-day period.

Pursuant to Article 59 of Legislative Decree No. 206/2005, the right of withdrawal is excluded or cannot be exercised in the following cases, which may apply to products sold on L'Impastautore: - Goods made to the consumer's specifications or clearly personalised, produced on the basis of the consumer's specific instructions. - Goods that are liable to deteriorate or expire rapidly (for example, fresh, perishable or short-dated food products). - Sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery. Consumers are encouraged to carefully review the characteristics of the product before placing an order. If there is any doubt as to whether an exception applies to a specific purchase, please contact the Data Controller using the details provided in Section 6.

Following the exercise of the right of withdrawal, the consumer is required to return the purchased goods without undue delay and, in any event, within fourteen (14) calendar days from the date on which the consumer communicated the decision to withdraw from the contract. The deadline is met if the consumer sends back the goods before the expiry of the fourteen-day period. The direct costs of returning the goods are borne by the consumer, unless otherwise agreed in writing with the Data Controller. Products must be returned intact, in their original packaging where possible, complete with all accessories, instructions and documentation originally included, and free from signs of use beyond what is necessary to assess the goods. The Data Controller reserves the right to deduct from the refund an amount corresponding to the diminished value of the goods, where such diminution is attributable to handling by the consumer that goes beyond what is permitted.

The Data Controller will reimburse all payments received from the consumer, including standard delivery costs (with the exception of any additional costs arising from the consumer's choice of a type of delivery other than the least expensive standard delivery offered), without undue delay and, in any event, within fourteen (14) calendar days from the date on which the Data Controller is informed of the consumer's decision to withdraw from the contract. The Data Controller may withhold the refund until the goods have been received, or until the consumer has supplied evidence of having sent back the goods, whichever is the earlier. The refund will be made using the same means of payment used by the consumer for the initial transaction. Since payments on the L'Impastautore website are processed through Stripe (Stripe Payments Europe, Ltd.), the refund will be credited to the original payment method used (credit/debit card or other instrument supported by Stripe) at no cost to the consumer as a result of the refund. The technical processing times for the credit to appear in the consumer's account depend on the consumer's bank or card issuer and may vary; the Data Controller is not responsible for any delays attributable to such third parties.
